America’s Injustice System Is Criminal

The Christmas season is a time to remember the unfortunate. Among the most unfortunate people are those who have been wrongly convicted and imprisoned.

The United States has a large number of wrongfully convicted. There are many reasons for this. One is that the US has the largest percentage of its citizens imprisoned of all countries in the world, including China. One of every 32 US adults is behind bars, on probation or on parole. Given a wrongful conviction rate, the larger the percentage of citizens in jails, the greater the number of wrongfully convicted.

According to the International Center for Prison Studies at King’s College in London, the US has 700,000 more of its citizens incarcerated than China, a country with a population four to five times larger than that of the US, and 1,330,000 more people in prison than crime-ridden Russia. The US has 5% of the world’s population and 25% of the world’s prisoners. The American incarceration rate is seven times higher than that of European countries. Either America is the land of criminals, or something is seriously wrong with the criminal justice (sic) system in “the land of the free.”

In the US the wrongful conviction rate is extremely high. One reason is that hardly any of the convicted have had a jury trial. No peers have heard the evidence against them and found them guilty. In the US criminal justice (sic) system, more than 95% of all felony cases are settled with a plea bargain.

Before jumping to the conclusion that an innocent person would not admit guilt, be aware of how the process works. Any defendant who stands trial faces more severe penalties if found guilty than if he agrees to a plea bargain. Prosecutors don’t like trials because they are time consuming and a lot of work. To discourage trials, prosecutors offer defendants reduced charges and lighter sentences than would result from a jury conviction. In the event a defendant insists upon his innocence, prosecutors pile on charges until the defendant’s lawyer and family convince the defendant that a jury is likely to give the prosecutor a conviction on at least one of the many charges and that the penalty will be greater than a negotiated plea.

The criminal justice (sic) system today consists of a process whereby a defendant is coerced into admitting to a crime in order to escape more severe punishment for maintaining his innocence. Many of the crimes for which people are imprisoned never occurred. They are made up crimes created by the process of negotiation to close a case.

This takes most of the work out of the system and, thereby, suits police, prosecutors, and judges to a tee. Police do not have to be careful about evidence, because they know that no more than one case out of twenty will ever be tested in the courtroom.

Prosecutors do not have to make decisions about which cases to prosecute or risk losing cases. By coercing pleas, prosecutors can prosecute every case and boast of extremely high conviction rates.

When prosecutors had to decide which cases to prosecute, they had to examine the evidence and to investigate the defendant’s side of the story. No more. The evidence seldom comes into play. In place of a determination of innocence or guilt, prosecutors negotiate with lawyers the crimes to which a defendant will enter a plea.

Prosecutors have lost sight of innocence and guilt. What we have today is a conveyor belt that convicts almost everyone who is charged. Every defense attorney knows that today prosecutors can purchase testimony against a defendant by paying a “witness” with money, dropped charges, or reduced time to testify against the defendant. Many prosecutors become highly annoyed at any disruption of the plea bargain conviction process. A defendant that incurs the prosecutor’s ire is certain to be framed on far more serious charges than a negotiated plea.

Going to trial is no guarantee that an innocent person will be acquitted. Prosecutors routinely withhold exculpatory evidence and suborn perjury. Generally, jurors trust prosecutors and are unaware of their inventory of dirty tricks. Few jurors can tell the difference between bogus evidence and real evidence. For example, psychologists and criminologists have established beyond all doubt that eye-witnesses are wrong 50% of the time. Yet, jurors usually believe eye-witnesses unless they think the witness has it in for the defendant and is lying.

Prosecutors – and there are still a few – who are meticulous about their cases and fair to defendants show poor results compared to the high convictions attained by prosecutors who run plea bargain mills and frame-up factories. Today’s criminal justice (sic) system is results orientated, not justice orientated.

In the past judges could give light sentences to people they believed had been wrongfully convicted. But “law and order conservatives” have taken sentencing discretion away from judges. Today prosecutors hold all the cards.

Many conservatives believe that prisons are full of hardened criminals who liberal judges are determined to release to prey upon society. In truth, the largest percentage of prisoners are drug users who are victims of the conservatives’ “war on drugs.” Drug offenses account for 49 percent of federal prison population growth between 1995 and 2003. Many of these prisoners are mothers arrested for drug use. The greatest victims of the drug laws are the children whose mothers are incarcerated.

As females become sexually active at younger and younger ages, state legislatures have stupidly raised the age at which it is legal to engage in sexual activity. Today, a significant percentage of new prisoners are young men imprisoned for engaging in sexual activity with teenage girls. In the US, criminal justice (sic) has more to do with ruining people than with punishing criminals.

I have written often about wrongful convictions. We know that wrongful conviction is a serious problem when the advent of DNA evidence has led to the release of a significant number of innocent people who were convicted of murderer and rape, and when a number of law schools feel that it is necessary for them to operate innocence projects that work for the release of the wrongfully convicted.

Prosecutors are like President Bush. They absolutely refuse to admit that they ever make a mistake and have to be forced to disgorge their innocent victims. Nothing makes a prosecutor more angry than to have to give back a wrongfully convicted person’s life.

Lt. William Strong and Christophe Gaynor are two of the hundreds of thousands of wrongfully convicted Americans whose lives have been ruined by an irresponsible and corrupt criminal justice (sic) system.

In Virginia, Lt. William Strong, the son of a military family, grew tired of his wife’s unfaithfulness and filed for divorce. The unfaithful wife retaliated by accusing Strong of marital rape. Neither police nor prosecutor investigated the charge. Instead, they proceeded to set Strong up for plea conviction. The arresting officer recommended Strong’s attorney, an incompetent who owed his cases to the police.

Strong insisted on a trial, but the arresting officer and attorney convinced Strong’s parents that with a plea their son would be out in a year. No one told Strong or his parents the implications of a plea, and Virginia Judge Westbrook Parker, playing to feminist voters, gave Strong a life sentence of 60 years.

The case has many unsavory appearances. If reports are true, the arresting officer paid numerous visits to Strong’s unfaithful wife, as did Strong’s attorney, and the arresting officer ended up separating from his wife and leaving the police force.

The perk kit exists and Strong could be given a DNA test, but Virginia refuses on the grounds that Strong admitted his guilt. Strong says the semen, if any, is that of the wife’s boyfriend.

Strong has been in prison for 15 years on the basis of zero evidence. He is in prison because he and his parents trusted the police officer and the criminal justice (sic) system.

Another Virginia case is that of Christophe Gaynor. Gaynor was the coach of an adolescent skate board team, which he took to New York City for a competition. One of the adolescents expressed his intention to buy drugs. Gaynor forbade it and threatened to report the boy to his parents.

The irresponsible kid retaliated by accusing Gaynor of sex abuse. There was no evidence. There was no investigation. Gaynor had never displayed any homosexual tendencies. The entire team knew the accusation was false. Gaynor went to trial. He was framed by the prosecutor with the help of the judge, who intimidated Gaynor’s witnesses by incarcerating one of the kids overnight without cause. Gaynor was sentenced to 32 years with no possibility of parole on the basis of no evidence, just an unproven accusation. His trial was full of irregularities, and the same judge who sentenced him denied Gaynor a new trial.

Ten years later, this past summer Noah J. Seidenberg, who brought the unproven accusation against Gaynor, died apparently of drug overdose at the age of 24 years.

There is no institution in America that is a greater failure than the criminal justice (sic) system. The system can do nothing but fail, because the search for truth and justice plays no part in the system. The prosecutor’s career depends on his conviction rate, not on discovering the guilt or innocence of the accused.

Virginia’s governor could pardon Strong and Gaynor. But feminists and “child advocates” would scream and yell, as would prosecutors and “law and order conservatives.” Nothing matters to these groups but their own single-issue, and justice is not part of it. In America justice cannot be done unless a governor is prepared to sacrifice his own political career in the interest of justice.

What kind of people are we when we exercise no oversight over a criminal justice (sic) system that destroys the lives of innocent people with lies?

Emotions hit another round of intensity with the uproar from the recently published map of Palestine from the State Information Service. The popular clamor asks, is this the ultimate goal of the PLO – remove Israel from the map of the middle east altogether?

Few can offer even the faintest glimmer of the chances for a peaceful resolution to the full scale warfare that has erupted in this ancient land. But how many people know the history of the last fifty plus years and the background that has brought the world to the brink of the ultimate holocaust? Millions of words have been written about who is at blame and the reasons for this eternal hatred. But a few pictures may explain better than appeals to reason.

United Nations Partition Plan – 1947 MAP

Starting with the United Nations Partition Plan, 1947, the original borders for the state of Israel are quite limited. This index illustrates the significant border changes after the 1949 War of Independence, after the six day war of 1967, than after the 1982 return of Sinai and the invasion of Lebanon, and finally after Palestinian autonomy and Lebanon withdrawal in 2000.

But the most notable map is the one that identifies the Israeli settlements on the West Bank. A careful analysis of the locations and the areas that are an effective no man’s land, demonstrates the consequences of the expanded settlements. It is hard to believe that Israel will ever agree to remove their own population from these areas.

Any rational person would likely conclude that a land for peace agreement would need to establish sovereignty for a Palestinian State. Under Ariel Sharon, the prospects for serious negotiations that will accept a geographic realignment are bleak. Yasser Arafat’s authority has been emasculated and his own survival is in serious doubt. Under these dire and hostile circumstances, America needs to take a sober approach and reexamine our own national interests in this endless conflict. Balance towards the middle east has never been the central tenant of U.S. foreign policy. It just might be time to start regarding the strife as unsolvable and change direction for the benefit of America.

The Bush administration has recognized that Sharon is out to inflict a maximum military response that will surely risk total open warfare. Colin Powell said about Sharon’s actions: ” he has to take a hard look at his policies to see whether they will work.”, hardly the clearest indication that U.S. support will be withheld from Israel. The prospect of a removal of that patronage is as likely as Sharon removing the Jewish settlements on the West Bank.

Efforts to foster an America obligation to side with Israel and defend the expansionist objectives of a greater Jewish state is insanity for our country. Can there be any doubt that the latest escalation in targeting Iraq as the next focal point in the ‘so called’ war on terror has more to do with providing cover for Sharon to unleash his forces, then eradicating imminent threats against America?

With the recent leaking of the Pentagon Nuclear Posture Review with its strategy to use first strike nuclear weapons, Pat Buchanan asks a question that demands a thoughtful response.

“Why would we use nuclear weapons on Iraq in retaliation for an attack on Israel, when Israel has its own nuclear weapons? Under what conceivable circumstances would we use atomic weapons on Syria? Does the United States claim a right of first use of atomic weapons against any “rogue state” that develops a weapon of mass destruction?”

Again the maps tell the tale . . . The encouragement of West Bank settlements have been policy of several Israeli administrations. Until the map changes, the blood will continue to spill. President Bush has not been an honest broker. Our national interest is imperiled when we subordinate our policies to the goals of foreign countries. This folly has been common for decades. Britain has played America for the fool while China treats us as her stooge. So why allow the U.S. to be Israel’s bitch?

Look at the maps, again . . . Then ask Bush if the destruction of an America city is the price that will need to be paid, in the defensive of any expanding empire? Isn’t it time to reverse the hostile attitudes of over a billion Muslims toward the U.S.? Surely you don’t want to change all those maps to redesign even more borders, policed by American troops? The solution is clear from our interests as a nation – remove the protective shield over the land of Abraham. It is a fight that has no benefit for us. Only pain and tears will come to our own land.

In an interview in Germain TV – the Israeli warlord, Ehud Olmert last night attempted to warn of a nuclear threat imposed by Iran- then he finally had to admitt that the Israelis has nuclear weapons them self.

“Israel is a democracy he claimed and he continued ” Israel doesn’t threaten any country with anything, we never did. The most that we have tried to get for ourselves is to try to live without terror” – said the terrorist leader the chef-d’oeuvre him self – in absurdity concealing the truth in a show of timidity – masking – with weakness the Israelis destruction plans for other sovereign countries .

The Israelis has refused to sign the Nuclear Non-Proliferation Treaty and is widely believed to have nuclear weapons.

Claiming that the Israelis had never threatened”any nation with annihilation,” while Iran had threatened to “wipe Israel off the map”. Olmert continued “Can you say that this is the same level, when Iranians are aspiring to have nuclear weapons as America, France, Israel and Russia?”

Olmert also said in the SAT1 television station, that Iran is, “aspiring to have nuclear weapons as America, France, Israel, Russia” – in admitting that Israel does in fact have nuclear weapons.

Israeli attacks on Lebanon in July 2006

Statements by Israeli military officials seem to confirm that the destruction of the infrastructure of Lebanon this summer was indeed a goal of the military campaign. On 13 July, shortly after the air strikes began, the Israel Defence Force Chief of Staff Lt-Gen Dan Halutz noted that all Beirut could be included among the targets and that “Nothing is safe in Lebanon as simple as that,”he said.

Deliberate destruction on a chatastrofic scale

During more than four weeks of ground and aerial bombardment of Lebanon by the Israeli armed forces, the country’s infrastructure suffered destruction on a catastrophic scale. Israeli forces pounded buildings into the ground, reducing entire neighbourhoods to rubble and turning villages and towns into ghost towns, as their inhabitants fled the bombardments. Main roads, bridges and petrol stations were blown to bits. Entire families were killed in air strikes on their homes or in their vehicles while fleeing the aerial assaults on their villages. Scores lay buried beneath the rubble of their houses for weeks, as the Red Cross and other rescue workers were prevented from accessing the areas by continuing Israeli strikes.

The hundreds of thousands of Lebanese who fled the bombardment was later facing the danger of unexploded munitions ( clusterbombs ) as they was heading home.

The Israeli Air Force launched more than 7,000 air attacks on about 7,000 targets in Lebanon between 12 July and 14 August, while the Navy conducted an additional 2,500 bombardments.The attacks, though widespread, particularly concentrated on certain areas. In addition to the human toll – an estimated 1,183 fatalities, about one third of whom have been children, 4,054 people injured and 970,000Lebanese people displaced– the civilian infrastructure was severely damaged. The Lebanese government estimates that 31 “vital points” (such as airports, ports, water and sewage treatment plants, electrical facilities) have been completely or partially destroyed, as have around 80 bridges and 94 roads.More than 25 fuel stations and around 900 commercial enterprises were hit. The number of residential properties, offices and shops completely destroyed exceeds 30,000. Two government hospitals – in Bint Jbeil and in Meis al-Jebel – were completely destroyed in Israeli attacks and three others were seriously damaged.

Israeli attack on Iraq on June 7 1981

Israeli warplanes struck 1981 the Osirak nuclear facility near Baghdad. This unprovoked attack by the Israelis was “a pre-emptive” strike to deny the Iraqis the capability of producing nuclear weapons. Iraqi defenses were taken by surprise and opened fire too late. In one minute and twenty seconds, the reactor was destroyed.

The Israelis had followed the Iraqi military buildup in the late 1970s. Saddam Hussein had assembled an army of 190,000 men organized into 12 divisions, augmented by 2,200 tanks and 450 aircraft. Both the Isreali Labor government of 1974-77 and the Likud government of 1977-81 closely watched and debated what to do about the Osirak reactor then being constructed with considerable French and Italian help.

Likud under Menachem Begin decided that the idea of Iraq – or any Arab state for that matter, holding nuclear weapons over the Israelis was intolerable. The decision to go ahead was taken and the attack was carried out by nine Israeli jets.

Israeli attacks on Syria October 5 2003

On 5 October Israeli warplanes launched their first attack inside Syria since the 1973 Arab-Israeli war.

The raid was “an attempt by the Israeli government to extract itself from crisis in Israel and the occupied territories by terrorise Syria and drag it and the rest of region into other wars because the Israelis are one of war and war is the justification of its existence,” the Syrian President Bashar Al-Assad told Al- Hayat newspaper on 7 October.

Despite ongoing protests, despite the illigality of the wall declared by an International Court, Israel has declared it legal to continue the construction of the apartheid wall around a northern Jerusalem neighbourhood.
Israel has always ‘danced to it’s own tune’…. it expects handouts and support from the west but never seems to do as told. How long will that continue I wonder…. with the loss of support both Olmert and Bush seem to be having lately. These facts continue to give the ‘eternal hope’ that the wall will one day be a thing of the past.

High Court: Security fence route in a-Ram legal

Nine-judge panel rejects petition filed by residents to stop construction around north Jerusalem neighborhood

A nine-judge High Court panel rejected an appeal issued by residents of a-Ram regarding the construction of the security fence around the north Jerusalem neighborhood.

“The various considerations in this matter justify the construction of the fence along its current route,” the judges said in their ruling.

“Our ruling is based on the assumption that the Israeli residents living in a-Ram will have adequate access to Jerusalem through the fence crossings, particularly through the Qalandiya crossing,” the judges said.

The petition was filed in an effort to block the construction of the fence along Highway 60, at a-Ram’s western border (inside Jerusalem territory).

Initially the court issued an interim order that prevented the fence construction in the area, and the state guaranteed that it would not perform permanent construction there until after a hearing would be held on the appeals. In august 2004 the interim order was annulled, thus freeing the state of its obligation.

During a cabinet meeting on the issue it was revealed that some 55,000 east Jerusalem Palestinians carrying blue (Israeli) identification cards would remain outside the Israeli part of the security fence should construction continue along the current route.

Outgoing High Court Judge Aharon Barak said in the ruling that, “The rights of al-Ram’s residents are not absolute; they can be obstructed if there is justification for it. One must make a distinction between harming ‘protected residents’ by constructing the fence in the West Bank and harm done to Israelis (citizens or permanent residents) due to the construction of the fence in the area and due to the construction of the fence in Israel .”

In the ruling Barak reiterated his stance that protecting Israelis is of the utmost importance, this despite the fact that some of a-Ram’s residents are Arabs holding Israeli identification cards.

Barak ruled: “It would be enough to say that it is a worthy objective if it is done for military needs (that aren’t political) that are meant to protect the lives of people living in the region or in Israel. Erecting the fence in the a-Ram area holds up under the prescriptions of this objective.

“It is meant to protect the lives of residents of the State in general, and residents of Jerusalem in particular, from terror activities coming out of West Bank territory. This is a worthy military objective that is meant to maintain security, and, as such, to protect human life, respect, and liberty,” Barak asserted.

Minority opinion

Judge Miriam Naor was in the minority opinion in regards to the segment of the route discussed in the petition, and established that the southern portion is not proportional.

According to her, “If my opinion were followed, we would accept the petition submitted by the residents of Dahiyat al-Barid, in accordance with the possibility for slight adjustments in the route, for instance, in the region of the Coptic church. Because mine is the minority opinion, there is no space for elaborating on the adjustments.”

Judge Naor added: “The fence, in every place it passes, damages the fabric of life. It creates hardship in some way or another on those going to work or returning home. It damages students, family ties, and culture… It obstructs the landscape. It stands as an ongoing and painful reminder that the two nations sitting on the land have still not been able to live in peace. However, the fence is vital to protect those needing protection from terrorist attacks.”

The Association for Civil Rights in Israel expressed their disappointment about the High Court ruling that authorized the route of the separation fence in the area of a-Ram, north of Jerusalem.

“The association is shocked and disappointed by the High Court ruling, according to which the jailing of masses of people with a cement wall from nearly all directions doesn’t violate human rights,” it reported. “The solutions indicated by the High Court, like using the border crossings, is not realistic. This bid proves that they don’t prevent the separation of the residents from Jerusalem, the center of their livelihoods and their lives.”

An Arab Woman Blues - December 13, 2006

Yesterday I let you in on my call to Radhee. Radhee calls me back today. He reports that:

- Abu Saleem’s son , Othman, 13 and half years old was kidnapped by the Iranian backed Death Squads whilst he went to buy some candies from the grocery shop.

His kidnappers asked for a ransom of 20’000 USD . Abu Saleem is a poor man , out of work for nearly a year now. He told them all his belongings did not amount to this sum.

He received another call later on during the day. The kidnappers have bargained down the price-10’000 USD or else…

Abu Saleem tried to negotiate with them . He offered that they take his house and all his belongings, he just wants his son alive. Later on in the evening, he received yet another call: “You son is dead , his body can be found in Kerbala.”

Othman’s mother wanted her son’s body at any cost so he can have a proper burial .

As it is too dangerous for this sunni family to go to Kerbala , a relative of the family , a shi’a, offered his help.
A coffin was arranged and Othman’s mother was to lay in it , pretending to be a dead corpse so they may reach Kerbala through checkpoints unharmed. A scene fit for a Louis Bunuel Film.

They arrived in Kerbala and after tedious haggling , they managed to retrieve the poor little boy’s body and took him back to the local cemetery.

13 years old Othman died from several shots between the legs and his skull was cracked open in half by a sledge hammer. Peace to you Othman.

- Seven members of the extended family were driven out of the Salman Pak area by US occupation forces with the cooperation of Iranian backed Death squads.

They sought refuge in another location in Iraq.

- On another note , 20 palestinians who have been driven out of their homes in Baghdad and found themselves in tents (again!), have been shot dead by the Iranian backed Death Squads.

- “The occupation is not the problem , it is the Saddamists and the Al Qaeda”, says ….Bush , no not Bush , but Hadi Al Ameri , an Iranian, sorry meant an Iraqi member of Parliament, responsible for “Security Matters”.

By the way , I told Radhee that I mentioned him on this blog . He says Merry Xmas to all of you and tells you not to believe the stuff you read , hear or see on the news . He textually said :
“Tell them , it is much much …..worse .”

With the appearance of the Danish documentary “The Secret War” (establishing, among other things, that Danish soldiers in Afghanistan in 2002, contrary to claims of the Danish government, captured 31 Afghans and handed them over to the Americans, knowing that the Americans did not respect the Geneva Conventions; the 31 Afghans were subsequently tortured, translator’s note), there has again come spotlight on Danish war participation. The myth about the “nice Danish soldiers” is crackling as the huge propaganda lie it really is.

Just like the murderer and those who order or help with committing the crime are criminals so are the Danish war politicians and soldiers who voluntarily and on payment participate in the dirty US aggressions guilty of all the crimes committed by the US-led occupying power, whether it is murder, poison gas attack or rape.

To claim that the Danish occupation troops are doing “a good job under difficult circumstances”, as even the anti-war politicians in the Danish national parliament claim, is not just whitewashing the monstrous crimes of the occupying power against the Iraqis and Afghans, but this chauvinist attitude also fertilizes the soil for new “peace-making” aggressions with Danish participation, causing more justified hatred against Denmark.

The Danish occupation forces are just as criminal as all other occupiers wanting to dictate the future of foreign countries according to their own interests.

Five U.S. servicemen die in Iraq

BAGHDAD, Dec 12, 2006(Reuters) – Three U.S. airmen were killed in action in western Iraq on Monday and two other soldiers died in separate incidents, the military said on Tuesday.

The U.S. military in Baghdad said the three airmen were killed by enemy action in Anbar province. One Marine died in “non-hostile action”, the ususal term for an accident, in the same area. A fifth serviceman died of what the army described as apparent natural causes.

Support for Israel in Congress is Based on Fear

I can tell you from personal experience that the support Israel has in the Congress is based completely on political fear — fear of defeat by anyone who does not do what Israel wants done. I can also tell you that very few members of Congress — at least when I served there — have any affection for Israel or for its Lobby. What they have is contempt, but it is silenced by fear of being found out exactly how they feel. I’ve heard too many cloakroom conversations in which members of the Senate will voice their bitter feelings about how they’re pushed around by the Lobby to think otherwise. In private one hears the dislike of Israel and the tactics of the Lobby, but not one of them is willing to risk the Lobby’s animosity by making their feelings public.

Thus, I see no desire on the part of Members of Congress to further any U.S. imperial dreams by using Israel as their pit bull. The only exceptions to that rule are the feelings of Jewish members, whom, I believe, are sincere in their efforts to keep U.S. money flowing to Israel. But that minority does not a U.S. imperial policy make.
