January 12, 2009 “Information Clearinghouse“ — The reason given by Israel for its massive assault upon Gaza, which continues as I write, is to halt the Qassam rocket launches into southern Israel staged by Hamas. But even the Israeli military admits that its ongoing operations will not necessarily halt the Qassams. The only way Israel could militarily do this would be to permanently reoccupy all of Gaza: lock it down. But this alternative has no support with the Israeli public. Permanent military reoccupation would expose thousands of Israeli soldiers to continued guerrilla attacks from Hamas. Over time, Israel would take unacceptable losses. Indeed, the Israeli army ended its occupation of southern Lebanon in 2000 for this very reason, because it sustained heavy losses from Hezbollah fighters. This means, quite simply, that there is no military solution to the Qassam rocket attacks.

“Israel’s current assault on the Gaza Strip cannot be justified by self-defense. Rather, it involves serious violations of international law, including war crimes. Senior Israeli political and military leaders may bear personal liability for their offenses, and they could be prosecuted by an international tribunal, or by nations practicing universal jurisdiction over grave international crimes. Hamas fighters have also violated the laws of warfare, but their misdeeds do not justify Israel’s acts.

The United Nations charter preserved the customary right of a state to retaliate against an “armed attack” from another state. The right has evolved to cover nonstate actors operating beyond the borders of the state claiming self-defense, and arguably would apply to Hamas. However, an armed attack involves serious violations of the peace. Minor border skirmishes are common, and if all were considered armed attacks, states could easily exploit them — as surrounding facts are often murky and unverifiable — to launch wars of aggression. That is exactly what Israel seems to be currently attempting.

Israel then broke the truce on Nov. 4, raiding the Gaza Strip and killing a Palestinian. Hamas retaliated with rocket fire; Israel then killed five more Palestinians. In the following days, Hamas continued rocket fire — yet still no Israelis died. Israel cannot claim self-defense against this escalation, because it was provoked by Israel’s own violation.

An armed attack that is not justified by self-defense is a war of aggression. Under the Nuremberg Principles affirmed by U.N. Resolution 95, aggression is a crime against peace.”

The 1967 war between Israel and Egypt, Jordan, and Syria was born of a lie that Israel had to wage a pre-emptive attack to defend itself, much as George Bush said the US had to wage a pre-emptive attack against Iraq because it had weapons of mass destruction.

Declassified documents in recent years of statements by Israeli Minister of Defense Moshe Dayan reveal the contrary. Since then, in violation of more than 100 UN resolutions and the Geneva Conventions, not to mention the international standard of unlawful aggression the US held Iraq to as justification for the first Gulf War in 1991, Israel has retained control of the Occupied Territories it captured in 1967 and committed numerous atrocities reported in its own media, to which the US is complicit in its American-made, Americanpaid DC9 Caterpillars, F16s, and Apache helicopters, among other weapons.

Israel fails to capture Gaza City

Over 80 Israeli soldiers have been wounded since the start of Gaza incursion.

Israeli forces have failed to capture Gaza City despite sending thousands of reserve soldiers to invade the city on Sunday, a Press TV correspondent reports.

Israeli troops and tanks which have been trying to enter the Gaza City are still engaging resistance fighters and have not succeeded to sweep into the city Press TV correspondent Akram al-Satarri reported.

On Sunday, thousands of Israeli reservists backed by tanks and helicopter gunships attacked eastern Gaza city, facing a strong resistance from Palestinian fighters.

On Monday, heavy clashes between the Palestinian fighters and Israeli forces are going on in East and South of the Gaza City.

Palestinian forces are fiercely fighting Israeli troops in Hay al-Zaytoun neighborhood in eastern Gaza, preventing them from penetrating inside the city.

More American (and NATO) troops “surging” in, more Taliban control in the countryside, more insurgent attacks, more sophisticated roadside bombs, more deadly suicide bombings, more dead American and NATO troops, more problems with U.S. supply lines into Afghanistan, more civilian deaths from American and NATO military operations, more U.S. bases being built, more billions of U.S. dollars needed for military operations — Secretary of Defense Robert Gates recently indicated that the build-up of U.S. forces alone in that country in the next fiscal year could cost an extra $5.5 billion — and, of course, yet more reports and studies indicating that everything yet tried to “stabilize” Afghanistan has gone desperately wrong.
