The OLC, as the New York Times explained in September 2007, holds a uniquely influential position, as it “interprets all laws that bear on the powers of the executive branch. The opinions of the head of the office are binding, except on the rare occasions when they are reversed by the attorney general or the president.” The legal opinions were, therefore, regarded as a “golden shield” by the administration, although, as lawyer Peter Weiss noted after I last wrote about the Bush administration’s war crimes, “it cannot be binding if it violates the constitution, or a jus cogens prohibition of international law, e.g. torture, or, perhaps, if it was made to order for the executive, as you demonstrate it was.”

TOP US officials, not a “few bad apples” of low rank, were behind harsh military interrogation tactics that spread from Guantanamo Bay to Afghanistan to Iraq, a new Senate report says.

The Senate Armed Services Committee’s 261-page report, the fruit of its investigation into US treatment of “war on terror” detainees, is likely to stoke the ongoing debate over US techniques widely seen as torture.

Democratic Senator Carl Levin said the report showed that claims by top aides to then-president George W Bush “that detainee abuses could be chalked up to the unauthorised acts of a ‘few bad apples’ were simply false”.

The report says US officials began preparing for what came to be known as “enhanced interrogation” techniques just a few months after the September 11, 2001 attacks and before a series of memos declaring such practices legal.

Opponents of last week’s release of memos detailing CIA interrogation techniques argue that they will provide enemies of the United States with a training manual to prepare their operatives for capture. The irony is that the U.S. military appears to have done the exact opposite, taking a training program that had been designed to prepare American soldiers to withstand torture by communist regimes seeking to extract false confessions and twisting it into a highly controversial interrogation manual.

The story of that mutation emerges in disquieting detail in a new report by the Senate Armed Services Committee (SASC) on the treatment of detainees in U.S. custody. It shows how U.S. interrogators at Abu Ghraib, GuantÁnamo Bay and camps in Afghanistan based some of their interrogations on techniques taken from the military’s Survival, Evasion, Resistance and Escape (SERE) training program. These techniques included waterboarding, walling (slamming detainees into a flexible wall), sleep deprivation, hooding and using dogs to inspire fear. (See pictures of life inside Guant[a {a}]namo.)

A Senate report further associates the former US administration with authorization of torture, raising the prospects of high-profile prosecution.

The Senate Armed Services Committee report, which escaped the Department of Defense’s declassification labyrinth after a year on Tuesday, claimed senior aides to the former US president George W. Bush endorsed the torture-aided grilling of the ‘terrorism suspects’.

It brought into attention the former defense secretary Donald Rumsfeld’s reported decision on December 2002 to give carte blanche to military interrogators to administer ‘enhanced interrogation techniques’ – a euphemism for torture used by the Bush administration.

A onetime senior adviser to former Secretary of State Condoleezza Rice says that the Bush Administration collected and destroyed memos by top officials arguing that torture methods used on detainees were wrong.

Philip Zelikow, former counselor at the State Department and a trusted adviser and deputy to former Secretary of State Condoleezza Rice, revealed the allegation in Foreign Policy Tuesday. He expanded on his remarks in an interview with MSNBC’s Rachel Maddow Tuesday night.

Zelikow says he was told to destroy copies of his own memo arguing against the torture techniques ultimately approved by the Bush Administration, and averred that his views against the torture techniques was shared by his Rice, his boss. But he believes some copies of the dissenting torture memos still exist.

“I mean, we’re trying to collect these and destroy them, and you have a copy, don’t you?” Zelikow told Maddow. “But I know copies that were retained in my building, and as I mentioned, Secretary Rice understood what I was doing on her behalf. I was her agent in these matters. And the — so I think copies still exist.”

“Why would they destroy them?” he added. “That’s a question they’ll have to answer.”

“Am I right in thinking that they would want to erase any evidence of the existence of a dissenting view within the administration because it would undercut the legal authority of the advice in those memos, the advice that those techniques would be legal?” Maddow asked.

“That is what I thought at the time,” Zelikow replied. “I had the same reaction you did. But I don’t know why they wanted to do it.”

On Thursday the spirit of George Orwell visited America, three times.

The first visit can be found in four memoranda prepared by Bush Administration lawyers which gave the actual go-ahead for the use of specific torture techniques on specific individuals, thus demolishing forever the absurd contention that the torture lawyers were ever only engaged in some abstract exercise without any direct application to incidents of torture. Here, we discover that Room 101 of the Ministry of Love (Miniluv) has been faithfully recreated by the Bush Team. In Orwell’s Nineteen Eighty-Four, Room 101 contained whatever a prisoner feared most, which would be let loose against him in an act calculated to inspire pure terror in the victim, to break him as an individual and to produce human material suitable for reconditioning. As a reminder, here’s the way the disclosure of Room 101 is realized in the excellent film version directed by Michael Radford (it begins at roughly 3:20 in the clip):

In the first of the four memos, we learn that one prisoner has been the subject of a careful psychoanalysis that had revealed a strong fear of insects, particularly stinging insects. The sudden onset of a phobia can produce automatic, uncontrollable reactions–the fear grips total control of the subject’s mind. Rapid heartbeat, a shortness of breath, trembling, an overwhelming desire to flee. The prisoner is prepared to do anything to escape the cause of the phobia.

SPOKANE, Wash.—George W. Bush insisted that the U.S. did not use torture.

But the four Bush-era Office of Legal Counsel memos released last week by the Obama administration’s Justice Department paint a starkly different picture. The declassified memos provided legal authorization for “harsh interrogation techniques” used by the Bush administration in the years following Sept. 11, 2001. They authorized (as listed in the Aug. 1, 2002, memo by then-Assistant Attorney General Jay Bybee) “walling … facial slap, cramped confinement, wall standing, stress positions, sleep deprivation, insects placed in a confinement box, and the waterboard.”

According to the American Civil Liberties Union, the OLC under Bush “became a facilitator for illegal government conduct, issuing dozens of memos meant to permit gross violations of domestic and international law.”

The memos authorize what the International Committee of the Red Cross called, in a leaked report, “treatment and interrogation techniques … that amounted to torture.”

These torture techniques were developed by two psychologists based in Spokane, Wash.: James Mitchell and Bruce Jessen. Their company, Mitchell Jessen & Associates, provided specialized training to members of the U.S. military to deal with capture by enemy forces. The training is called SERE, for Survival, Evasion, Resistance, Escape. Mitchell and Jessen, both psychologists, were contracted by the U.S. government to train interrogators with techniques they claimed would break prisoners.

BERLIN — European prosecutors are likely to investigate CIA and Bush administration officials on suspicion of violating an international ban on torture if they are not held legally accountable at home, according to U.N. officials and human rights lawyers.

Many European officials and civil liberties groups said they were disappointed by President Obama’s opposition to trials of CIA interrogators who subjected terrorism suspects to waterboarding and other harsh tactics. They said the release last week of secret U.S.

Justice Department memos authorizing the techniques will make it easier for foreign prosecutors to open probes if U.S. officials do not.

Last week, we pointed out that one of the newly released Bush-era memos inadvertently confirmed that the CIA held an al-Qaeda suspect [1] named Hassan Ghul in a secret prison and subjected him to what Bush administration lawyers called “enhanced interrogation techniques.” The CIA has never acknowledged holding Ghul, and his whereabouts today are secret.

But Ghul is not the only such prisoner who remains missing. At least three dozen others who were held in the CIA’s secret prisons overseas appear to be missing as well. Efforts by human rights organizations to track their whereabouts have been unsuccessful, and no foreign governments have acknowledged holding them. (See the full list. [2])

According to New Yorker reporter Jane Mayer, Helgerson concluded that some detainees were allegedly killed during interrogations.

In an interview with Harper’s magazine last year, Mayer said Helgerson “investigated several alleged homicides involving CIA detainees” and forwarded several of those cases “to the Justice Department for further consideration and potential prosecution.”


CIA Inspector General John Helgerson raised concerns in a 2004 top-secret report his office prepared about the legality of the interrogation techniques agency interrogators used against admitted 9/11 mastermind Khalid Sheikh Mohammed.

In the report, Helgerson concluded that the CIA’s “enhanced interrogation” program “appeared to constitute cruel, inhumane and degrading treatment, as defined by the International Convention Against Torture” and the interrogation of Mohammed “could expose agency officers to legal liability,” according to a Nov. 9, 2005 report published in the New York Times.

As the controversy surrounding revelations of the Bush administration’s torture program builds, the CIA has attempted to diffuse the furore by claiming that the torture of Khalid Sheik Mohammed prevented a terror attack on an L.A. skyscraper, a completely ludicrous assertion since the credibility of the alleged “L.A. attack plot” was debunked by scores of intelligence professionals years ago.

“The Central Intelligence Agency told CNSNews.com today that it stands by the assertion made in a May 30, 2005 Justice Department memo that the use of “enhanced techniques” of interrogation on al Qaeda leader Khalid Sheik Mohammed (KSM) — including the use of waterboarding — caused KSM to reveal information that allowed the U.S. government to thwart a planned attack on Los Angeles,” reports CNS News.

Lawyers for the government have admitted that a senior MI5 officer gave false evidence to the high court in the case of former Guantánamo Bay prisoner Binyam Mohamed.

The admission, combined with an apology, is contained in a letter from Treasury solicitor David Mackie to Lord Justice Thomas and Mr Justice Lloyd Jones, who tomorrow will hear fresh demands from lawyers representing Mohamed, and the media, for the disclosure of information about who was complicit in his interrogation and torture.

9/11 : We are avoiding physics of WTC

Recently, explosive scientific evidence proving that high-tech nano-thermitic material was present in the World Trade Center dust was reported in a scientific journal titled, “Active Thermitic Material Discovered in Dust from the 9/11 World Trade Center Catastrophe.”

Authored by an international team of physicists and chemists, the article in the Open Chemical Physics Journal 2009, Vol. 2, said, “We conclude that the red layer of the red/gray chips we have discovered in the WTC dust is active, unreacted thermitic material, incorporating nanotechnology, and is a highly energetic pyrotechnic or explosive material.”

In short, the paper destroys the official story that “no evidence” exists for explosive or pyrotechnic materials in the WTC towers, and is devastating to the mainstream “explanation” that three WTC buildings were somehow demolished by the two hijacked airplanes. Further, it reinforces the position of over 600 registered architects and engineers who have shown the impossibilities of a gravity-driven “collapse” as put fourth with the “official” version.

Because of the difficulty in refuting the solid evidence of explosives inside those three towers, defenders of the “official story” have resorted to ridicule the character of the article’s publisher, and those engineers that trust physics over politics.

Why hasn’t this been reported in the mainstream media? Perhaps because most are afraid to really look into the physics of 9/11, since fear of the known is sometimes worse then fear of the unknown.
