A Challenge to the Supreme Court: Can the US Kill Iraqi Children Legally?

“Imagine if a U.S. cruise missile were to land on a kindergarten and kill 165 children. Imagine now that it was launched knowing it would hit that kindergarten, and further, that one of these missiles was launched at a different kindergarten every day for a month. That’s 5,000 children.

“To kill that many children as a matter of state policy would be unspeakable. The American commander in chief would be condemned as a barbarian. And yet, that is what the economic embargo of Iraq has done.”

This is from a Seattle Times editorialsix years ago. For ten years I have wanted to ask one very basic question: Not only were the sanctions barbaric, but were the sanctions legal? Could the US cause the deaths of thousands of Iraqi children every month for years and do so legally?

I will finally get a chance to ask this of the US Supreme Court in a petition I’ll file this month.

I need to show what deaths occurred and why: UNICEF reported “there would have been half a million fewer deaths of children under-five [in Iraq] during the eight year period 1991 to 1998.” The New England Journal of Medicine explained: “The [Gulf War] destruction of the country’s power plants had brought its entire system of water purification and distribution to a halt, leading to epidemics of cholera, typhoid fever, and gastroenteritis, particularly among children.”

In 2004, Robert Fisk (British International Journalist of the Year seven times) put it this way: “In other words, the United States and Britain . . . were well aware that the principal result of the bombing campaign — and of sanctions — would be the physical degradation and sickening and deaths of Iraqi civilians. Biological warfare might prove to be a better description. The ultimate nature of the 1991 Gulf War for Iraqi civilians now became clear. Bomb now: die later.”

Did US officials intend this or understand it would occur as a result of US policies? In 1991, USAF Colonel Warden (called the architect of the Gulf Air War) said we bombed Iraq’s electrical plants for “long-term leverage.” Another Pentagon bombing planner stated more candidly: “People say, ‘You didn’t recognize that it was going to have an effect on water or sewage.’ Well, what were we trying to do with [UN economic] sanctions — help out the Iraqi people? No. What we were doing with the attacks on infrastructure was to accelerate the effect of sanctions.”

In 1998, Senator Craig of Idaho testified in a Senate hearing on Iraq sanctions: “The use of food as a weapon is wrong. Starving populations into submission is poor foreign policy.” In 1996, Madeleine Albright famously said on national TV that the deaths of half a million Iraqi children were “worth the price” — but that no child would have died if Saddam just complied with the UN. But she contradicted her own position and that of Secretary of State Baker, who in 1991 informed Congress: “UN sanctions [would stay] in place so long as Saddam remains in power.”

No one can say that our government officials didn’t know what their policies were doing.

In 1997, I traveled to Iraq to deliver medicine to desperately needy civilians. In response, the US government fined me $10,000. I announced I’d refuse to pay the fine. Several Seattle attorneys offered pro bono support. Our case began in district court and then to appeals court.

Despite widespread notions to the contrary, it was not hard to show that US policies lethally targeted civilians, using famine and epidemic as tools of coercion, violating international law.

But the courts declined to invalidate the US embargo. According to the trial court, provisions of the Convention on the Rights of the Child didn’t count because the US (along with Somalia) hasn’t ratified it. The Geneva Convention is not “self-executing” so it doesn’t help me! And the Genocide Convention, which was partially ratified, created no “substantive or procedural right enforceable by law by any party in any proceeding.” Finally, the court ruled, if Congress wants to violate customary international law it may do so and the US courts are powerless to stop it.

I hope the Supreme Court will decide otherwise. The issue is simple: there are certain norms of international behavior — often called jus cogens — that are so fundamental to the rule of law that no nation may violate them. Genocide, wars of aggression, war crimes, and crimes against humanity are among them. So is the killing of 500,000 children to coerce a foreign government.

The Real Cost of the Iraq War: 50,000 U.S. Casualties

Death is not the only measure of loss in Iraq. What about all of the lost limbs, bloodshed and other casualties that aren’t being reported?

To bring the human cost to Americans of the invasion and occupation of Iraq home, antiwar groups across the country are marking mark the 3,000th death of a member of its military components (at this writing the total is 3,004).

But by focusing only on the number of dead Americans we are being manipulated along with the media and public by the administration’s determination to minimize the cost in blood of establishing permanent military bases in the heart of the Middle East oil patch.

That public relations strategy consists of prohibiting images of the dead and wounded returning home and those of U.S. casualties in Iraq in the U.S. media as well as aggressive efforts to prevent such coverage by foreign media –including deadly attacks on Al-Jazeera reporters and offices. It also plants stories and interviews, leaks to FOX and other Pentagon-friendly reporters and provides generous payola to foreign (especially Iraqi) news sources.

Still, the most consistent propaganda effort since the invasion aims to keep public attention away from the actual amount of blood being shed by American military victims of the war and their families. That cost now exceeds 50,000 casualties — a far cry from the 3,000 to which most of the public is restricted to know.

“Casualties” in the military sense is the total number made unavailable for duty from all causes, including deaths and wounds suffered in combat as well as injuries, accidents and illness in a war “theater” such as “Operation Iraqi Freedom” (the official Pentagon name for the invasion and occupation). So whether caused by “hostile” (24,965 as of Dec.27) or “non-hostile” (25,406 as of Dec. 2) causes, the Pentagon’s own web sites record a toll of more than 50,000 so far in “OIF.”

However, for most Americans who depend on mass media for information, the approaching number of only 3,000 is the only measure of the loss of life and limb the media allow them to know. For the rest of us, here are the facts: The Pentagon reports deaths on a daily basis at although its own total always lags behind the wire services number because it insists survivors must be informed before a dead solider, marine, sailor or airman can be added to the casualty lists. But the Pentagon only reports the wounded on the weekly basis (usually on Tuesdays) at the same site and it reports the non fatal casualties from non hostile causes only monthly and on another website.

>From those sources, we can count U.S. military occupation forces casualties as more than 50,371 as of Dec. 27. The total (as above) includes 2,400 killed and 22,565 wounded (which includes both severely and less severely wounded) by what the Pentagon classifies as “hostile” causes. By that date, another 583 military personnel had died from “non hostile” causes such as accidents, suicides (there were 99 “self inflicted fatalities”) and illness and, as of Dec. 2, another 24,823 had been injured or become ill seriously enough to require medical evacuation. According the excellent siteIraq Coalition Casualty Count, another 147 U.S. “contractors” have also been killed since they invaded Iraq.

I urge opponents of the war to make the public aware that the actual human cost of the invasion and occupation of Iraq exceeds 50,000 troops and their families who have suffered death and often life-long disability — of whom the 3,000 are just one tragic part.

Can We Let Intelligence Officials Lie With Impunity?”

01/05/06 “Information Clearing House” — — Lies have consequences . All those who helped President George W. Bush launch a war of aggression—termed by Nuremberg “the supreme international crime”—have blood on their hands and must be held accountable. This includes corrupt intelligence officials. Otherwise, look for them to perform the same service in facilitating war on Iran.

“They should have been shot,” said former State Department intelligence director, Carl Ford, referring to ex-CIA director George Tenet and his deputy John McLaughlin, for their “fundamentally dishonest” cooking of intelligence to please the White House. Ford was alluding to “intelligence” on the menacing but non-existent mobile biological weapons laboratories in Iraq.

Ford was angry that Tenet and McLaughlin persisted in portraying the labs as real several months after they had been duly warned that they existed only in the imagination of intelligence analysts who, in their own eagerness to please, had glommed onto second-hand tales told by a con-man appropriately dubbed “Curveball.” In fact, Tenet and McLaughlin had been warned about Curveball long before they let then-Secretary of State Colin Powell shame himself, and the rest of us, by peddling Curveball’s wares at the U.N. Security Council on February 5, 2003.

After the war began, those same analysts, still “leaning forward,” misrepresented a tractor-trailer found in Iraq outfitted with industrial equipment as one of the mobile bio-labs. Former U.N. weapons inspector David Kay, then working for NBC News, obliged by pointing out the equipment “where the biological process took place… Literally, there is nothing else for which it could be used.”

George Tenet knows a good man when he sees him. A few weeks later he hired Kay to lead the Pentagon-created Iraq Survey Group in the famous search to find other (equally non-existent, it turned out) “weapons of mass destruction.” (Eventually Kay, a scientist given to empirical evidence more than faith-based intelligence, became the skunk at the picnic when, in January 2004, he insisted on telling senators the truth: “We were almost all wrong—and I certainly include myself here.” But that came later.)

On May 28, 2003, CIA’s intrepid analysts cooked up a fraudulent six-page report claiming that the trailer discovered earlier in May was proof they had been right about Iraq’s “bio-weapons labs.” They then performed what could be called a “night-time requisition,” getting the only Defense Intelligence Agency analyst sympathetic to their position to provide DIA “coordination,” (which was subsequently withdrawn by DIA). On May 29, President George W. Bush, visiting Poland, proudly announced on Polish TV, “We have found the weapons of mass destruction.”

When the State Department’s Intelligence and Research (INR) analysts realized that this was not some kind of Polish joke, they “went ballistic,” according to Ford, who immediately warned Colin Powell that there was a problem. Tenet must have learned of this quickly, for he called Ford on the carpet, literally, the following day. No shrinking violet, Ford held his ground. He told Tenet and McLaughlin, “That report is one of the worst intelligence assessments I’ve ever read.”

This vignette—and several like it—are found in Hubris: The Inside Story of Spin, Scandal, and the Selling of the Iraq War by Michael Isikoff and David Corn, who say Ford is still angry over the fraudulent paper. Ford told the authors:

It was clear that they [Tenet and McLaughlin] had been personally involved in the preparation of the report… It wasn’t just that it was wrong. They lied.

This, of course, was just one episode in the long drama of deliberate perversion of intelligence to grease the skids for justifying the invasion of Iraq—the most serious foreign policy blunder in our nation’s 230-year history.

“Hubris,” the overweening arrogance that brought down many a protagonist of the Greek tragedies, is an aptly-chosen title for the revealing Isikoff/Corn study. Some of the ground they cover is familiar to us Veteran Intelligence Professionals for Sanity (VIPS), who well before the war started chronicling the Bush administration’s lies. What makes the book different is its cumulative impact—the detailed, first-hand accounts of lie and cover-up, lie and cover-up, ad nauseam .

Protagonists need a supporting cast. And many of the dramatis personae were intelligence analysts—former colleagues of mine. The question lingers: How could they allow themselves to be seduced into enlisting in the meretricious march to mayhem in Iraq? Much of the answer (and much of the reason this misguided war is allowed to continue) lies in the fact that those planning and facilitating the war in Iraq are not fighting it. Unlike Vietnam, no one “important” is being asked to put life and limb at risk; nor, generally speaking, are their children. Interestingly, most of our troops come from towns with populations of less than 10,000.

Theirs Not To Reason Why

Into the valley of death rode the 3,000. “U.S. Toll in Iraq Reaches 3,000” screamed The Washington Post ’s lead story on New Year’s Day, which included the Pentagon’s count of more than 22,000 troops injured. As is known, the Pentagon does not count dead Iraqis, but reputable estimates put that number at about 650,000. As we pass this sad milestone, it behooves us to pause and consider the enormity of what has been allowed to happen—and how to prevent it from happening again. The House and Senate Intelligence committees in the new Congress need to reinstitute genuine oversight, including a close look at why so many intelligence officers cooperated in the dishonesty leading to war. We owe that to the 25,000, not to mention the 650,000.

Start with Tenet and McLaughlin and include Alan Foley, the retired chief of CIA’s Center for Weapons Intelligence, Nonproliferation and Arms Control (WINPAC) and devotee of imaginative intelligence on bio-labs, uranium from Niger, aluminum tubes and other artifices to justify an unnecessary war. Most of the suspects owe their meteoric careers in large measure to Defense Secretary Robert Gates who, as head of CIA analysis and later as CIA director, institutionalized the politicization of CIA analysis more than 20 years ago, mostly by moving malleable managers up the pay scale.

Another beneficiary of Gates is George Tenet who, as staff director of the Senate Intelligence committee in 1991, helped Gates overcome strong opposition to his confirmation as director. It is a safe bet that Gates returned the favor by recommending that Tenet be kept on as director when George W. Bush became president in 2001.

Gates learned well at the knee of his original mentor, William Casey, President Ronald Reagan’s CIA director. They and those that followed had remarkable success in perpetrating the dual crime of which, long ago, Socrates was accused: making the worse case appear the better and corrupting the youth. Thus, in September 2002 when Senate Intelligence committee Democrats Dick Durban and Bob Graham insisted on a National Intelligence Estimate on “weapons of mass destruction” before Congress voted for war, George Tenet found himself the ultimate beneficiary of Robert Gates’ finely tuned Geiger counter for corruptibility. The pliant managers promoted originally by Gates were happy to conjure up a formal estimate written to the specifications of their frequent visitor, Vice President Dick Cheney.

Those who tell consequential lies need to be held accountable. That includes, of course, Colin Powell. Congress needs to ask the former Secretary of State why he decided to disregard the objections of his own intelligence analysts and turned instead to faith-based intelligence for war. He has expressed regret for his scandalous performance at the U.N., but only because it put “a blot on my record.” I would like to see him try that out on Cindy Sheehan and 3,000 other bereaved mothers.

Powell and I grew up a mile from each other in the Bronx. There we had a word for his forte, which remains a ubiquitous scourge in Washington. It was both noun and verb: “brownnose.” And it has nothing to do with skin color. It was a familiar word before I learned “sycophant.” Webster’s provides this meaning: “To ingratiate oneself with, to curry favor with; from the implication that servility is equivalent to kissing the hinder parts of the person from whom advancement is sought.”

Rep. Lloyd Doggett, D, Texas, put the effects of all this most succinctly in a floor speech last year:

This war was launched without an immediate threat to our families… Radical “know-it-all” ideologues here in Washington bent facts, distorted intelligence and perpetrated lies designed to mislead the American people into believing a third-rate thug had a hand in the 9/11 tragedy and was soon to unleash a mushroom cloud.

Much is being said today about honoring the sacrifices of our fallen soldiers. Perhaps the best way to do that is to find out who did the misleading and hold them to account before they do it again

01/05/06 “Information Clearing House” — — Regrettably, the most immoral among us remember the past, observe the criminal implications and repeat it. In 1939, six years after the Madrid Conference, Hitler met with his military chiefs and delivered a speech that today some are determined to emulate:

“It was knowingly and lightheartedly that Genghis Khan sent thousands of women and children to their deaths. History sees in him only the founder of a state. The aim of war is not to reach definite lines but to annihilate the enemy physically. It is by this means that we shall obtain the living space that we need. Who today speaks of the massacre of the Armenians?”

In 1996, Richard Perle, Douglas Feith, and David Wurmser prepared a paper for former Prime Minister Netanyahu regarding Israel’s grand strategy in the Middle East. This paper involved the removal of Saddam Hossein from power . Not without coincidence, the three men were given high level positions in the Bush Administration. Perle became Pentagon’s Chair of the Defense Policy Board (2001-04), Douglas Feith who was forced to resign from his post as Deputy Undersecretary of Defense for Policy following investigations into allegations of distorting prewar intelligence on Iraq; and last but not least, Wurmser who became special assistant to the Undersecretary of State for Arms Control (now advisor to Dick Cheney) whose wife Meyrav founded MEMRI, the very institution which translates everything that comes out of Iran – and elsewhere in the Middle East.

On May 2, 2003, President Bush landed on the flight deck of the USS Lincoln, above him a large sign that read “Mission Accomplished” – Indeed this was the accomplishment of “A Clean Break: A New Strategy for Securing the Realm,” recommended by Perle, Feith, and Wurmser. Three years later, Americans would see more than 3000 body-bags brought home, the violent death of more than 655,000 Iraqis, and the execution of Saddam Hossein. Those injured and maimed, those we starved and deprived with our sanctions have been buried in stupor’s cemetery.

Our trance is deliberate, for we are the executioners – the rope that hung Saddam and massacred hundreds of thousands was our ignorance, fear, and complacency. We never questioned the morality of the sanctions, nor their effectiveness. Not a single tear was shed for the Iraqi children that died as a result of the sanctions. The old and the sick were not our concern as long as they weakened the tyrant, so we thought. But their skeletons were the pillars of his palaces, our ignorance profound, our consciousness dormant, we ravaged and buried a whole nation.

Congress was cowered into violating international law based on lies. Only 6 congressional members read the NIE (national intelligent estimate) on which a decision was made to go to war. Over 450 members elected to represent the American people neglected their duty. Emboldened, the cabal of neo-cons bribed and intimidated the United Nations to sanction Iran. After all, it was next on the ‘A clean Break’ and on the wish list. On our part, abandoning morality, salivating at the thought of taking more lives so as to empower the malignant tumor of destruction and death, we clung to our weapons – And so I say we are the Angels of Death who kill with our complacency, ignorance and fear.

The three feed on each other; the fear on ignorance and complacency on fear. When Khomeini with millions of followers made this claim about Zionism: “this regime occupying Jerusalem must vanish from the page of time, just as the Shah’s regime in Iran had vanished.”, Israel provided Iran with weapons considering it to be a lesser enemy than Iraq [but an enemy nonetheless]. And one must not forget the Iran Contra affair which took place during the Reagan Administration when Iran was sold arms so that the Contras in Nicaragua could be financed. Khomeini’s remarks, his elevated status as an Imam did not seem to be an ‘existential threat’ to Israel or the US, odd that a president who is without power, should bring the wrath of the world. But then, Iraq had not been defeated and reduced to rubbles yet – Iran’s number had not been called. Nor had the MEK been called to serve its masters, Israel, to provide false intelligence on Iran’s nuclear program. Nor had MEMRI been established to misinterpret and misguide the public.

In 2002, the MEK (aka NCRI), ‘exposed’ Iran’s undeclared nuclear activities. Of interest is the fact that more recently, in 2005, the same group declared that the “production of Beryllium and polonium-210 is being carried out ” implicating Iran in nuclear bomb-making. Fortunately, intensive and intrusive inspections by IAEA dismissed the charges to the chagrin of Bolton. [side note: Polonium-210 is what was used to poison the Russian spy in London. He met with Leonid Nevzlin in Tel-Aviv before meeting his demise. Nevzlin is under investigation for his death . What is not being investigated is the fact Russian plants are under IAEA inspection while Israeli plants are not; it is also noteworthy that this misinformation about Iran is more in line with Israel’s weapon of demonization as well as well as that of assassination – Polonium-210).

Regardless of lack of evidence, the US persisted with its push for sanctions.

We are in the hand of history makers, learning from the past, destroying the future. Friends have been bought. Allies turned into enemies. China whose ambition is to regain its lost suzerainty, and without a doubt the only power challenging the United States, acted out of character for “China also believes sanctions are not an effective way to resolve problems and China has been opposing economic sanctions or pressures imposed on relevant countries, including on the Darfur issue”(BBC international reports) . In November 20, 2004, China stated that it “opposed” moves to refer Iran to the United Nations Security Council over its nuclear program (Spencer) . The package from the US would seem to include selling out Taiwan. It would seem that when the President was talking about ‘sacrifice’, he was talking not only about more American lives, but perhaps he had Taiwan in mind. After all, history has shown that US foreign policy has never been in favor of democracies.

In 2005, Washington opposed Tel-Aviv’s sale of sensitive military equipment to China. Specifically, the Harpy Killer unmanned drones as Washington feared that the advanced US defense technology contained in Israeli equipment would be used against Taiwan . It now seems that the destruction of Iran is far more important than the ideals of democracy. On December 3, 2007, the Israeli Prime Minister announced that he would be visiting China to meet with President Hu in order to negotiate trade and Iran’s nuclear program . No doubt Israel will be passing high tech equipment to China in appreciation of its cooperation.

Resolution 1737 is not meant to stop the sensitive nuclear materials and technology; it was a first step towards demanding further sanctions on the Iranian people. Under secretary of State, Nicholas Burns stated: “We don’t think this resolution is enough in itself. And we’re certainly not going to put all our eggs in a UN basket,” . After harsher sanctions have been imposed, with or without consensus, the United States plans to attack Iran and massacre millions of innocent Iranians. The US toll would depend on its method of warfare.

If there should be a future left to those looking back at this decade, they will remember genocide at so many fronts – But it is safe to venture and guess that they would find it extraordinary that we were able to sit in our sitting rooms and without lifting a finger, enabled the death of millions of people across the world.

The curtain has dropped on the Theater of the Absurd directed by the Iranian regime last week – an event that convened figures from the margins of the Holocaust-denial scene and its “alternative” researchers. In Israel the conference was covered with an emphasis on the statements by the participants and the reactions of Israeli politicians. True, this was an international conference behind which was a country that declares its desire to bring about the fall of the “Zionist regime” – but beyond that hides a deeper factor, which is indicative of the connection between contemporary Israeli identity and the Holocaust.

“If the occurrence of the event (the Holocaust) is cast into doubt, the identity of the Zionist regime will also be cast into doubt.” From these words, spoken at the opening session by Iranian Foreign Minister Manouchehr Mottaki, it emerges that the Iranian regime has correctly identified the connections that exist in Israel between the Holocaust and local politics. One of the formative historical events of the West today, whose significance is relevant to all of humanity, the Holocaust is continuing more than 60 years later to provide Israel with an alibi for the deviancy of its political choices.

An Israel with no real distinction between the establishment political left and the right with all its offshoots, continues to make use of the Holocaust in a way that combines cynicism and boorishness. Even though there is indeed a considerable and complex connection between the Holocaust and Israeli political culture, there isn’t – nor has there ever been – any justification for harnessing its memory for the sake of preserving the continuing occupation project that Israel has been conducting for 40 years now in the territories.

Israel’s attitude toward the Holocaust is not really derived from the way in which the leadership is responding to the incendiary declarations of Iranian President Mahmoud Ahmadinejad and his propagandists, which above all testify to the speakers themselves. It is possible to learn about this attitude from, among other things, the way in which it relates to the tens of thousands of survivors in whose flesh and minds the Nazis’ crimes are etched, who live here in disgraceful conditions and below the poverty line.

However, the real treatment of the survivors is apparently a lot less glamorous than the cult of the worship surrounding those who were murdered, which provides a stage for every politician who is seeking his way to the center of the consensus. Thus, as was recently published again in Haaretz, the state is continuing to nationalize the reparations monies that are transferred to it for the benefit of those hundreds of thousands of survivors – while criminally neglecting many of them.

The primitive instrumentalist use that Iranian politics is making of the Holocaust is nothing but a mirror image of the way the memory of the Holocaust is exploited in political life in Israel. One of the aims of the Iranian campaign to “research the historical truth” surrounding the Holocaust is to unravel the system of justifications that Israeli politics has been accustomed to using in its all-too-frequent definition of the criticism of those politics, expressed both domestically and abroad as being tainted with anti-Semitism. Thus the role of the Holocaust as the sole justification for the existence of Israel has been sharpened, instead of focusing on the fact that today more than 7 million people of varied origins and nationalities are living in this country – a place which in most cases is their only possible home.

If indeed the Iranian foreign minister is correct and this is the sole source of legitimacy from which the Zionist project derives today, then apparently the time has indeed come for a radical revision of the concept of Zionism. And it would be a good thing if this is done before Ahmadinejad and his ultra-Orthodox partners from Brooklyn launch a new production.
