The United Nations‘ most senior human rights official said last night that the Israeli military may have committed war crimes in Gaza. The warning came as Israeli troops pressed on with the deadly offensive in defiance of a UN security council resolution calling for a ceasefire.

Navi Pillay, the UN high commissioner for human rights, has called for “credible, independent and transparent” investigations into possible violations of humanitarian law, and singled out an incident this week in Zeitoun, south-east of Gaza City, where up to 30 Palestinians in one house were killed by Israeli shelling.

Pillay, a former international criminal court judge from South Africa, told the BBC the incident “appears to have all the elements of war crimes”.

The accusation came as Israel kept up its two-week-old air and ground offensive in Gaza and dismissed as “unworkable” the UN security council resolution which had called for “an immediate, durable and fully respected ceasefire”.

Some lucky survivors of the Samouni clan in Gaza testify against Israel’s horrific attacks on civilians.

Israel is barring foreign journalists from Gaza so it is difficult to verify completely the survivors’ accounts about an incident that left up to 70 civilians dead.

They contain allegations that Israeli forces shelled a building where they had previously put a large number of civilians, killed a child in cold blood, used human shields and failed to provide proper treatment to survivors.

Even though they were nearby, Israeli soldiers were found not to have taken action to help four children who spent 48 hours clinging to what the ambulance crew believed to be their mothers’ corpses.

There is no way any rational person could view these attacks as anything but a war of aggression resulting in the indiscriminate murder of innocent Gazan civilians. These are war crimes. Period.

Via the LRC blog, Ron Paul explains why a pro-Israel war resolution is a mistake:

– “…the weapons being used to kill so many Palestinians are American weapons.”

– “If you look at the history you’ll find out that Hamas was encouraged and really started by Israel because they wanted Hamas to counteract Yasser Arafat.”

Hamas’s violations are no justification for Israel’s actions.

Israel’s current assault on the Gaza Strip cannot be justified by self-defense. Rather, it involves serious violations of international law, including war crimes. Senior Israeli political and military leaders may bear personal liability for their offenses, and they could be prosecuted by an international tribunal, or by nations practicing universal jurisdiction over grave international crimes. Hamas fighters have also violated the laws of warfare, but their misdeeds do not justify Israel’s acts.

The United Nations charter preserved the customary right of a state to retaliate against an “armed attack” from another state. The right has evolved to cover nonstate actors operating beyond the borders of the state claiming self-defense, and arguably would apply to Hamas. However, an armed attack involves serious violations of the peace. Minor border skirmishes are common, and if all were considered armed attacks, states could easily exploit them — as surrounding facts are often murky and unverifiable — to launch wars of aggression. That is exactly what Israel seems to be currently attempting.

Israel’s bombardment of Gaza is not self-defence – it’s a war crime

ISRAEL has sought to justify its military attacks on Gaza by stating that it amounts to an act of “self-defence” as recognised by Article 51, United Nations Charter. We categorically reject this contention.

The rocket attacks on Israel by Hamas deplorable as they are, do not, in terms of scale and effect amount to an armed attack entitling Israel to rely on self-defence. Under international law self-defence is an act of last resort and is subject to the customary rules of proportionality and necessity.

The killing of almost 800 Palestinians, mostly civilians, and more than 3,000 injuries, accompanied by the destruction of schools, mosques, houses, UN compounds and government buildings, which Israel has a responsibility to protect under the Fourth Geneva Convention, is not commensurate to the deaths caused by Hamas rocket fire.

Anyone who justifies this war also justifies all its crimes. Anyone who sees it as a defensive war must bear the moral responsibility for its consequences. The Association for Civil Rights in Israel recently published its annual report for 2007. (I’m certain things have gotten worse in the last 2 years, especially with a “deadly” government in Israel.)

According to these polls, 78 percent of the Jewish population opposes having Arab parties or ministers in the governing coalition, 50 percent is afraid when they hear Arabic in the street, 75 percent would not agree to live in an apartment building with Arabs, and 55 percent support the idea that the state should encourage the emigration of Arabs from Israel.

The authors of this report compared the current situation with previous years’ and concluded that racism towards Arab citizens is on a continual rise.

Is there then no racism in Israel? Of course there is. If 74 percent of the youth believe that “Arabs are unclean,” this is ugly racism that needs to be uprooted. And there are other instances: the discrimination against and isolation of immigrants from Ethiopia, and the setting of limits on the immigration of the Falashmura. During the time of the British White Paper, which set limits on immigration by Jews, tens of thousands demonstrated in the streets in opposition. Similar decisions are now being implemented by a Jewish Israeli government against Jews in Ethiopia. This is racism pure and simple.

GAZA-Kebiadaban pasukan Israel terus terungkap. Kemarin, giliran PBB yang membongkar pembantaian yang dilakukan militer Negeri Zionis itu di sebuah rumah di Zeitun, dekat Kota Gaza, berdasarkan keterangan beberapa saksi korban yang selamat dari insiden itu.

Seperti dilansir AFP, dengan dalih ingin menyelamatkan, 110 warga sipil Palestina di digiring masuk ke rumah itu. Namun, misi heroik itu hanyalah topeng. Sehari kemudian, serdadu Israel malah memberondongkan peluru senjata otomatis ke tengah massa yang meringkuk di rumah tersebut. Buntutnya pun otomatis mengerikan. 30 orang tewas seketika.

”Berdasar sejumlah kesaksian, pada 4 Januari, serdadu Israel mengevakuasi sekitar 110 warga Palestina ke sebuah rumah di Zeitun (setengahnya anak-anak) dan mengatakan agar tak kemana-mana. Dua puluh empat jam kemudian, serdadu Israel menembak rumah tersebut berulangkali, menewaskan setidaknya 30 orang,” kata seorang pejabat PBB kepada Agence France-Presse.

Menurut lembaga PBB untuk bantuan kemanusiaan, OCHA, sepanjang 13 hari serangan Israel hingga kemarin, kejadian itulah yang paling tragis. Bila serangan Israel masih tetap berlanjut dan tak ada satu kekuatan pun yang dapat menghentikan agresi Israel ke Gaza, daftar insiden paling tragis dipastikan akan terus bertambah.

January 10, 2009 — Madame Speaker, I strongly oppose H. Res. 34, which was rushed to the floor with almost no prior notice and without consideration by the House Foreign Affairs Committee. The resolution clearly takes one side in a conflict that has nothing to do with the United States or US interests. I am concerned that the weapons currently being used by Israel against the Palestinians in Gaza are made in America and paid for by American taxpayers. What will adopting this resolution do to the perception of the United States in the Muslim and Arab world? What kind of blowback might we see from this? What moral responsibility do we have for the violence in Israel and Gaza after having provided so much military support to one side?

THE SHADOURA family live in the Moaskar Jabaliya area in the north of the Gaza Strip. They are originally from the town of Majdal in 1948 Palestine, now Ashkelon in present-day Israel. Their simple white, one-storey house is just yards away from the Fakhoura UN school where 42 people died, 20 of them children, when Israeli tanks opened fire on a busy intersection. Paramedics and eyewitnesses reported seeing nothing but “limbs and meat” in the street at the time. Witnesses report that four tank shells smashed into the ground releasing flying chunks of burning shrapnel.

319. THE JEWS

Several letters have been received by me asking me to declare my views about the Arab-Jew question in Palestine and the persecution of the Jews in Germany. It is not without hesitation that I venture to offer my views on this very difficult question.

My sympathies are all with the Jews. I have known them intimately in South Africa. Some of them became life-long companions. Through these friends I came to learn much of their age-long persecution. They have been the untouchables of Christianity. The parallel between their treatment by Christians and the treatment of untouchables by Hindus is very close. Religious sanction has been invoked in both cases for the justification of the inhuman treatment meted out to them. Apart from the friendships, therefore, there is the more common universal reason for my sympathy for the Jews.

But my sympathy does not blind me to the requirements of justice. The cry for the national home for the Jews does not make much appeal to me. The sanction for it is sought in the Bible and the tenacity with which the Jews have hankered after return to Palestine. Why should they not, like other peoples of the earth, make that country their home where they are born and where they earn their livelihood?

MIDEAST: Israel Rejected Hamas Ceasefire Offer in December

WASHINGTON, Jan 9 (IPS) – Contrary to Israel’s argument that it was forced to launch its air and ground offensive against Gaza in order to stop the firing of rockets into its territory, Hamas proposed in mid-December to return to the original Hamas-Israel ceasefire arrangement, according to a U.S.-based source who has been briefed on the proposal.

The proposal to renew the ceasefire was presented by a high-level Hamas delegation to Egyptian Minister of Intelligence Omar Suleiman at a meeting in Cairo Dec. 14. The delegation, said to have included Moussa Abu Marzouk, the second-ranking official in the Hamas political bureau in Damascus, told Suleiman that Hamas was prepared to stop all rocket attacks against Israel if the Israelis would open up the Gaza border crossings and pledge not to launch attacks in Gaza.

The Hamas officials insisted that Israel not be allowed to close or reduce commercial traffic through border crossings for political purposes, as it had done during the six-month lull, according to the source. They asked Suleiman, who had served as mediator between Israel and Hamas in negotiating the original six-month Gaza ceasefire last spring, to “put pressure” on Israel to take that the ceasefire proposal seriously.
