Kritik Pesantren Sidogiri terhadap Quraish Shihab

Belum lama ini saya menerima kiriman berupa sebuah buku terbitan Pondok Pesantren Sidogiri, Pasuruan, Jawa Timur. Judulnya cukup panjang: ”Mungkinkah Sunnah-Syiah dalam Ukhuwah? Jawaban atas Buku Dr. Quraish Shihab (Sunnah-Syiah Bergandengan Tangan! Mungkinkah?)” Penulisnya adalah Tim Penulis Buku Pustaka SIDOGIRI, Pondok Pesantren Sidogiri, yang dipimpin seorang anak muda bernama Ahmad Qusyairi Ismail.

Membaca buku ini halaman demi halaman, muncul rasa syukur yang sangat mendalam. Bahwa, dari sebuah pesantren yang berlokasi di pelosok Jawa Timur, terlahir sebuah buku ilmiah yang bermutu tinggi, yang kualitas ilmiahnya mampu menandingi buku karya Prof. Dr. Quraish Shihab yang dikritik oleh buku ini. Buku dari Pesantren Sidogiri ini terbilang cukup cepat terbitnya. Cetakan pertamanya keluar pada September 2007. Padahal, cetakan pertama buku Quraish Shihab terbit pada Maret 2007. Mengingat banyaknya rujukan primer yang dikutip dalam buku ini, kita patut mengacungi jempol untuk para penulis dari Pesantren tersebut.

Salah satu kesimpulan Quraish Shihab dalam bukunya ialah, bahwa Sunni dan Syiah adalah dua mazhab yang berbeda. ”Kesamaan-kesamaan yang terdapat pada kedua mazhab ini berlipat ganda dibandingkan dengan perbedaan-perbedaan dan sebab-sebabnya. Perbedaan antara kedua mazhab – dimana pun ditemukan – adalah perbedaan cara pandang dan penafsiran, bukan perbedaan dalam ushul (prinsip-prinsip dasar) keimanan, tidak juga dan Rukun-rukun Islam.” (Cetakan II, hal. 265).

Berbeda dengan Quraish Shihab, pada bagian sampul belakang buku terbitan Pesantren Sidogiri, dikutip sambutan KH. A. Nawawi Abdul Djalil, pengasuh Pesantren Sidogiri yang menegaskan: ”Mungkin saja, Syiah tidak akan pernah habis sampai hari kiamat dan menjadi tantangan utama akidah Ahlusunnah. Oleh karena itu, kajian sungguh-sungguh yang dilakukan anak-anak muda seperti ananda Qusyairi dan kawan-kawannya ini, menurut saya merupakan langkah penting untuk membendung pengaruh aliran sesat semacam Syiah.”

Telaah Kritis Atas Islam Inklusif Kang Jalal

إِنَّ الْحَمْدَ للهِ نَحْمَدُهُ وَنَسْتَعِيْنُهُ وَنَسْتَغْفِرُهُ وَنَعُوْذُ بِاللهِ مِنْ شُرُورِ أَنْفُسِنَا وَمِنْ سَيِّئَاتَ أَعْمَالِنَا مَنْ يَهْدِ اللهُ فَلاَ مُضِلَّ لَه، وَمَنْ يُضْلِلْ فَلاَ هَادِيَ لَه، أَشْهَدُ أَنْ لاَ إِلهَ إِلاَّ اللهُ وَحْدَهُ لاَ شَرِيْكَ لَه وَأَشْهَدُ أَنَّ محمداً عَبْدُه ورسولُه، اللَّهُمَّ صَلِّ وَسَلِّمْ عَلَى نَبِيِّنَا وَسَيِّدِنَا مُحَمَّدٍ وَعَلَى آلِهِ وَصَحْبِهِ وَمَنْ سَارَ عَلَى نَهْجِهِمْ أَجْمَعِيْنَ، أَمَّا بَعْدُ:

Pada hari Rabu, 14 Syawwal 1426 H atau tanggal 16 November 2005, seperti biasanya BSM mengadakan kajian rutin mingguan. Pada kesempatan tersebut yang mendapat kesempatan sebagai pemateri kajian adalah Kang Jalal, dengan tema “Islam dan Pergeseran Peradaban”, meskipun ternyata isi kajiannya sedikit keluar jalur dari inti temanya. Sebab Kang Jalal boleh dikatakan lebih banyak berbicara dan menyinggung paham ekslusifisme, inklusifisme, dan pluralisme dalam Islam. Selanjutnya Kang Jalal sendiri menyatakan bahwa dia adalah seorang inklusif-semi pluralis.

Berikut ini adalah suatu perbandingan kritis yang singkat terhadap beberapa pernyataan Kang Jalal yang semoga dapat menjadi wacana untuk memperluas wawasan kita.

NON-MUSLIM1 JUGA BISA MASUK SURGA?

Kang Jalal menyatakan bahwa umat non-muslim pada zaman ini juga mempunyai kesempatan dan kemungkinan untuk masuk Surga, kalau mereka beramal shalih serta beriman kepada Allah dan hari akhir, berdalil dengan ayat:

إِنَّ الَّذِينَ ءَامَنُوا وَالَّذِينَ هَادُوا وَالنَّصَارَى وَالصَّابِئِينَ مَنْ ءَامَنَ بِاللَّهِ وَالْيَوْمِ الْآخِرِ وَعَمِلَ صَالِحًا فَلَهُمْ أَجْرُهُمْ عِنْدَ رَبِّهِمْ وَلَا خَوْفٌ عَلَيْهِمْ وَلَا هُمْ يَحْزَنُونَ

“Sesungguhnya orang-orang yang beriman, orang-orang Yahudi, orang-orang Nasrani dan ash-Shabi-iin,2 siapa saja di antara mereka yang benar-benar beriman kepada Allah, hari kemudian dan beramal saleh, mereka akan menerima pahala dari Tuhan mereka, tidak ada kekhawatiran terhadap mereka, dan tidak (pula) mereka bersedih hati.” (QS. Al-Baqarah: 62).

Mengingat ini adalah risalah singkat –sebagaimana sudah disebutkan-, maka kami hanya akan menyebutkan dua penafsiran tentang ayat di atas sebagai perbandingan. Barangsiapa yang ingin mendapat pengetahuan yang lebih tentang ayat tersebut hendaklah merujuk kepada kitab-kitab tafsir yang ada.

Penafsiran pertama menyatakan bahwa ayat di atas berkaitan dengan orang-orang yang beriman dari kalangan umat ini dan umat-umat terdahulu sebelum diutusnya Rasulullah `, bahwa jika mereka beriman dengan keimanan yang benar dan beramal shalih maka mereka akan mendapatkan balasan yang baik, tidak takut dan tidak pula bersedih hati.3

Syaikh ‘Abdurrahman bin Nashir as-Sa’di menyatakan bahwa ayat ini bertujuan untuk mencegah terjadinya kesalahpahaman yang mungkin timbul karena ayat-ayat sebelumnya yang berisi celaan terhadap Bani Israil4 –yang juga menyingkap keburukan mereka-. Dikhawatirkan sebagian orang akan menyangka bahwa seluruh Bani Israil terkena keumuman celaan tersebut. Karena itu Allah jelaskan secara khusus bahwa orang-orang yang beriman secara benar dan beramal shalih di kalangan mereka -begitu pula dengan umat ini- tidak termasuk dalam keumuman celaan tersebut.

Kesetaraan Gender

Wacana dan isu ‘kesetaraan gender¡’ (KG) kini menggema luar biasa di Indonesia. Berbagai program digelar untuk mensosialisasikan program ini. Bahkan, seolah-olah, paham ini sudah dianggap sebagai satu kebenaran, yang tidak boleh dipersoalkan. Seperti halnya beberapa paham lain yang datang dari peradaban Barat, banyak orang yang kemudian mencari pembenarannya dalam ayat-ayat al-Quran dan hadits. Sekarang, ada istilah

pembangunan berwawasan gender
politik berwawasan gender
pendidikan berwawasan gender
fiqih berwawasan gender tafsir berspektif gender,dan sebagainya.

Sebagian aktivis gender kemudian mengangkat isu penjajahan dan penindasan perempuan oleh laki-laki. Seolah-olah, selama ini kaum wanita mundur karena ditindas oleh laki-laki. Lalu, kaum wanita disuruh bergerak untuk melawan apa yang mereka katakan sebagai hegemoni lakilaki.

Entah mengapa, negara-negara Barat dan juga LSM-LSM mereka, kini sangat aktif mendanai berbagai proyek penelitian dan gerakan KG. Bahkan, sasaran paham ini sudah semakin spesifik. Ada yang khusus menggarap pesantren, ada ormas Islam, ada partai, perguruan Tinggi, dan sekolahsekolah.

Tentu tidak ada salahnya umat Islam bertanya: apa dan untuk siapa sebenarnya program ini?

Timbul tanda tanya besar mengapa pihak Barat begitu bersemangat mengkampanyekan kesetaraan gender di dunia Islam, ketika pada saat yang sama, isu tersebut mengalami stagnasi dan mulai ditinggalkan oleh sebagian masyarakat Barat sendiri?

Banyak problem rakyat Indonesia lain seperti kemiskinan dan kesehatan yang masih memerlukan bantuan. Mengapa justru proyek-proyek KG yang mudah mendapatkan pendanaan? Jadi, KG tidak lepas dari isu pemberdayaan perempuan dan gerakan feminisme. Dan ini tidak bisa dilepaskan dari sejarah kelam masyarakat Barat pada abad pertengahan.

Menurut McKay dalam bukunya a History of Western Society (1983), terdapat bukti-bukti kuat yang mengindikasikan bahwa perempuan telah dianggap sebagai makhluk inferior, bahkan pada tahun 1595, seorang profesor dari Wittenberg University melakukan perdebatan serius mengenai apakah perempuan itu manusia atau bukan. Istilah feminisme berasal dari bahasa Latin femina, perempuan. Konon dari kata fides dan minus menjadi fe-minus, artinya kurang iman. Perempuan di Barat, dalam sejarahnya, memang diperlakukan seperti manusia kurang iman. Wajah dunia Barat pun dianggap terlalu macho. Tapi lawan kata feminis, yakni masculine tidak lantas berarti penuh iman. Masculinus atau masculinity sering diartikan sebagai strength of sexuality. Maka dari itu dalam agama Barat, wanita Barat itu korban inuisisi dan di masyakarat jadi korban perkosaan laki-laki. Tak pelak lagi agama dan laki-laki menjadi musuh wanita Barat.

Itulah worldview Barat asal feminisme lahir. Dan memang worldview, menurut Al-Attas, Alparslan, Thomas Wall, Ninian Smart dll. adalah sumber aktifitas intelektual dan sosial. Buktinya worldview Barat liberal menghasilkan feminist liberal, Barat Marxis membuahkan feminis Marxis, Barat posmodern melahirkan feminism posmo dan seterusnya.

Seperti liberalisme tuntutan feminis liberal adalah hak ekonomi dan kemudian hak politik. Dalam bukunya A Vindication of the Rights of Women, Mary Wollstonecraft menyimpulkan di abad ke 18, wanita mulai kerja luar rumah karena didorong oleh kapitalisme industri. Tahun 2004, sebuah Pusat Studi Wanita di sebuah universitas Islam di Yogya karta menerbitkan buku berjudul Isu-Isu Gender dalam Kurikulum Pendidikan Dasar dan Menengah. Buku ini merupakan bagian dari proyek penyebaran paham Kesetaraan Gender kepada umat Islam, melalui perombakan kurikulum tingkat sekolah dasar dan menengah.

Bagi banyak kaum Muslimin, tentu saja, isinya cukup mengagetkan. Sebab, hampir semua hukum Islam yang memberikan perlakuan berbeda terhadap lakilaki dan wanita, digugat.

Misalnya, ajaran Islam tentang saksi dan wali nikah, kenapa harus laki-laki?
Mengapa kambing aqiqah untuk bayi wanita harus satu, sedangkan laki-laki dua ekor?
Mengapa wanita harus izin suami jika mau bepergian atau berpuasa sunnah?
Mengapa imam shalat harus laki-laki?
Mengapa yang azan juga laki-laki?
Mengapa wanita harus menjadi Ibu rumah tangga dan mengasuh anak?
Mengapa wanita harus menyusui anaknya?
Bukankah laki-laki juga bisa menyusui anaknya?

Ditulis dalam buku ini:
Seorang Ibu hanya wajib melakukan hal-hal yang sifatnya kodrati seperti mengandung dan melahirkan. Sedangkan halhal yang bersifat diluar qodrati itu dapat dilakukan oleh seorang Bapak. Seperti mengasuh, menyusui (dapat diganti dengan botol), membimbing, merawat dan membesarkan, memberi makan dan minum dan menjaga keselamatan keluarga. (hal. 42-43).

Menurut para penulis buku ini, semua hukum Islam yang mendiskriminasi wanita merupakan produk dari budaya patriarkhi, yang memang dikuasai oleh lakilaki, untuk menjajah wanita.

AMINA WADUD

Pada Hari Jumat, 18 Maret 2005, dunia Islam dikejutkan oleh sebuah peristiwa di Synod House, gereja Cathedral St. John, di Manhattan, New York, AS. Ketika itu, seorang tokoh Liberal yang aktif memperjuangkan paham kesetaraan gender (gender equality), Prof. Dr. Amina Wadud, menjadi imam dan khatib salat Jumat. Jamaahnya sekitar 100 orang, terdiri dari pria wanita yang sejajar tanpa dipisah. Muazinnya seorang wanita, tanpa jilbab. Dia ikut salat Jumat juga.

Peristiwa serupa diulangi pada 17 Oktober 2008. Kali ini bertempat di Oxford Center, Inggris. Wadud menjadi imam shalat di Pusat Pendidikan Muslim di Oxford dengan makmum laki-laki dan perempuan, campur-aduk. Aktivis liberal dari Pusat Kependidikan Muslim Oxford (MECO), sebagai pihak pengundang Wadud, menggambarkan peristiwa ini sebagai perlompatan kemajuan untuk takdir teologish.

Tak pelak, aksi Amina Wadud tersebut mendapatkan banyak kritikan. Majmaal-Fiqhi al-Islami (MFI), badan internasional dalam hukum Fiqh Islam, mengkritik tindakan Wadud. MFI yang bernaung di bawah OIC ini menilai apa yang dilakukan Wadud ini sebagai bidah yang menyesatkan dan musibah. Dr Yusuf Qardhawi, ulama kharismatik asal Qatar menyebut Wadud telah menyimpang dari ajaran Islam.

Tapi, tindakan Wadud disambut gembira oleh pegiat gender di Indonesia. Mereka mendukung langkah Wadud. Tindakan Wadud mereka pandang sebagai usaha penting untuk menjebol tradisi patriarki yang merendahkan martabat wanita. Seorang aktivis kesetaraan gender dari daerah Jawa Barat menulis dalam makalahnya: Maka kehadiran dan penampilan perempuan di hadapan laki-laki apalagi dalam shalat, dianggap atau diyakini bisa mengganggu pikiran dan hati laki-laki pada umumnya. Pandangan ini sesungguhnya muncul dari mainstream kebudayaan laki-laki atau yang sering kali disebut pandangan kebudayaan patriarki.

Amina Wadud adalah seorang feminis. Ia juga seorang dosen di Virginia Commonwealth University. Gelar Ph.D diraihnya di The University of Michigan tahun 1988 dalam bidang Studi Islam dan Arab. Wadud juga pernah menimba ilmu Studi Arab di Mesir pada American University in Cairo, belajar studi Quran dan tafsir di Cairo University dan mengambil kursus filsafat di Universitas Al Azhar.Spesialisasi Wadud di bidang gender dan studi Quran. Ia menulis buku berjudul Qurfan and Women : Rereading the Sacred Text from a Woman Perspective. Buku ini di-Indonesiakan dengan judul Quran menurut Wanita. Melalui buku ini, Wadud berusaha membongkar cara menafsirkan Al Quran model klasik yang dinilainya menghasilkan tafsir yang bias…

“When any modern state tortures even a few victims, the stigma compromises its majesty and corrupts its integrity. Its officials must spin an ever more complex web of lies that, in the end, weakens the bonds of trust and the rule of law that are the sine qua non of a democracy. And, beyond its borders, allies and enemies turn away in collective revulsion.” – Prof. Alfred W. McCoy, A Question of Torture (2006).

Truth and justice are essential components of democracy and the rule of law. We cannot move forward unless we honestly examine our past. Accuracy is vital to every decision we make, be it impeachment, prosecution or a restoration of our nation’s honor and integrity.

This is the first in a four-part series of articles which will strive to correct misperceptions arising from the erroneous blending of military and CIA torture. This task has become especially relevant now that the Justice Department’s the Office of Legal Counsel (OLC), the very section which had issued the torture memos, tasked by former Attorney General Michael Mukasey with investigating itself, has now released a recommendation that none of the authors of the torture memos be prosecuted. This recommendation stands in stark contrast to our nation’s post-World War II decision to prosecute German judges for war crimes at Nuremberg.

Part I addresses the relatively public involvement of the U.S. military and private contractors at Guantanamo, Afghanistan and Iraq. It will dispel the notion that the Bush White House sought out independent legal opinions from the OLC before deciding to torture.

Part II will discuss the CIA’s dark beginnings, including its recruitment of former Nazis, its devotion to covert “psychological operations” as a founding principle, the experiments on unwitting subjects that were part of a maniacal quest to crack the code of human consciousness, and the scientific studies that led to KUBARK, the CIA’s torture manual.

Part III provides a vital historical account of CIA torture applied by surrogates in developing nations as a component of empire, an account that belies the suggestion made by the The New York Times that CIA torture first arose as an aftermath of 9/11.

Part IV will address the CIA’s involvement in extraordinary rendition and an ultra-secret system of “black-sites” into which “ghost detainees” would disappear. It will show how the techniques used on “ghost detainees” are the culmination of a half-century of CIA research and practices…

I don’t want to give the wrong impression. All nations possess a legitimate need to gather intelligence. There have been large numbers of extraordinarily dedicated CIA employees, like Ray McGovern and Valerie Plame Wilson, who have sought to protect this nation from harm. But there is the dark side of the agency, a covert branch which has engaged in deception, intrigue, torture and assassinations, all designed to destabilize democratic governments in order to advance and consolidate the power and influence of a US-based, multi-national corporate empire.

In Part I of this four-part series, I described how the George W. Bush administration did not wait for legal “permission” from its Department of Justice before embarking on its plan to use torture as means of forcing confessions and other information from detainees. In “Prosecute or Perish” I stressed that the current torture scandal is the product of a half-century of CIA torture; that by failing to prosecute those who tortured in our name in the same manner that we prosecuted the Japanese officers who waterboarded my father during World War II, we not only will expose our nation to the charge of hypocrisy but will endanger the very survival of our constitutional democracy and the rule of law.

“President Obama said on Wednesday (May 13, 2009) that he is seeking to block the release of photographs that depict American military personnel abusing captives in Iraq and Afghanistan, worrying that the images could “further inflame anti-American opinion.”

See below for proof of how the Average American supports his/her President, in trying to sweep America’s dirty laundry under the carpet.

What’s funny about all of this is, (as Rick Salutin so aptly put it), is the idiotic American assumption that the rest of the world is as ignorant about America’s terrible record of human-rights abuses, as the Average American is.

Suspected war criminal to lead U.S. forces in Afghanistan

On July 22 2006, Human Rights Watch issued a report titled “No blood, no foul” about American torture practices at three facilities in Iraq. One of them was Camp Nama, which was operated by the Joint Special Operations Command (JSOC), under the direction of then Major General Stanley McChrystal.

McChrystal was officially based at Fort Bragg in North Carolina, but he was a frequent visitor to Camp Nama and other Special Forces bases in Iraq and Afghanistan where forces under his command were based.

An interrogator at Camp Nama described locking prisoners in shipping containers for 24 hours at a time in extreme heat; exposing them to extreme cold with periodic soaking in cold water; bombardment with bright lights and loud music; sleep deprivation; and severe beatings. When he and other interrogators went to the colonel in charge and expressed concern that this kind of treatment was not legal, and that they might be investigated by the military’s Criminal Investigation Division or the International Committee of the Red Cross, the colonel told them he had “this directly from General McChrystal and the Pentagon that there’s no way that the Red Cross could get in.”

If They Knew the Truth, They’d Hate Us Even More

We Americans like to think of ourselves as civilized people.  Historically, we have supported our government in war under the belief that our government and our soldiers are honorable and that we do not engage in unjust wars.  Ugly things like genocide, torture, naked aggression, raping, pillaging, and scorched earth policies are things that others do, not us.  Since we are so good and virginal in every sense, we reason that others hate us only because of our goodness and purity.  If they knew the truth about us, we think, they would love us.

Abu Ghraib

Yet, if this is so, why is it that we need to hide from the world the activities of our soldiers and intelligence agents over seas?  Why cannot we, the “liberators” of Iraq, show the world the lovely photos of our soldiers at work Abu Ghraib?  Why must the CIA consider destroying the records of American conduct in the prisons at Guantanamo?  We are so pure, clean, honorable, and all, aren’t we?  What have we got to worry about?

Could it be that those baby faced soldiers we praise and pay tribute to are not as honorable as we would like to believe?  According to the latest body keeping the Oval Office seat warm, release of photos showing the activities of our soldiers, activities ordered by George Bush and Dick Cheney, would make the world hate us more than they already do and would, as a consequence, endanger the lives of our soldiers. Just how horrible are these images?  We shall discuss that shortly, but before we do, let us consider this claim itself by translating it into smaller statements:

  1. If the world knew what we were really like, they would hate us more than that already do.
  2. If the world knew what our soldiers do, they would rise up and kill our soldiers.
  3. Our government cares about the lives of our soldiers, and so we cannot release the photos.

‘US strike killed 95 children in Afghanistan’

About 150 civilians were killed on Tuesday when US warplanes dropped bombs on two villages last week

Afghan officials reveal that 95 children are among the civilians killed in a US-led strike that is surrounded with the controversy over use of white phosphorous.

Afghan lawmaker Obaidullah Helali who headed a delegation investigating the booming in the western province of Farah confirmed the children’s massacre on such a large scale.

The delegation also delivered condolence payments to the victims, ordered by President Hamid Karzai.

Nearly 150 civilians were killed last Tuesday when US warplanes dropped bombs on two villages in the Bala Baluk district in the western province of Farah.

Human rights and medical officials also accused the US forces of using flesh-eating chemical white phosphorus during the lethal strikes.

No war crimes in Gaza says Israel

The Israel Defense Force IDF) responsible for the barbaric invasion of Gaza looked at reports of attacks on civilians, infrastructure, medical personnel, hospitals, United Nations buildings, and at the use of white phosphorous. The IDF concluded that the IDF had “adhered to international law and maintained a high level of professionalism and morality.”

Why then refuse to cooperate with the United Nations’ investigation into Gaza war crimes? And why drop the probe into reports by its own soldiers that the IDF was guilty of war crimes?

The truth about Gaza

Nearly 1400 people were killed, 314 of them children, and thousands were wounded. War crimes against children: new report on the 313 children killed during Gaza offensive


A new report released today reveals the true extent of child killings by Israeli forces in the Gaza Strip during its 23 day offensive on Gaza between 27 December 2008 and 18 January 2009.

The Palestinian Centre for Human Rights (PCHR) is publishing War Crimes Against Children in response to the unprecedented number of children killed by Israeli forces in its latest operation; a total of 313 children under the age of eighteen. Containing numerous eye witness testimonies, the report brings to light Israel’s widespread targeting of unarmed civilians, including children, throughout the offensive.

‘Operation Cast Lead’ was the biggest Israeli military operation in the Gaza Strip in nearly 42 years of occupation. 1,414 Palestinians were killed, and PCHR investigations have found the overwhelming majority, 83 per cent, were civilians. One of the cases in the report is that of 18 month old Farah al-Helu, who was killed on 4 January. The al-Helu family had been told to evacuate their house in Zaytoun, eastern Gaza, but while they were attempting to flee, Israeli soldiers opened fire on them. Farah was shot in the stomach and bled to death two hours later.

War Crimes Against Children exposes the abject failure of Israeli authorities to uphold international humanitarian law, which provides protection for children in armed conflict and the lack of adequate precautions taken to distinguish between civilians and military targets. The report also details indiscriminate shelling of homes and schools where internally displaced people were sheltering, the psychological impact of the offensive, and the alarming scale of physical injuries inflicted on young people.
